Alcohol, Tobacco, and Misc Licensing
License Descriptions:
Class "A" licensees may sell beer to consumers in original packages or containers for off-premises consumption only.
"Class A" licensees may sell intoxicating liquor to consumers only in original packages or containers for off-premises consumption.
"Class B" licensees may sell intoxicating liquor to consumers by the glass for on-premises consumption. If the municipality enacts an ordinance under §125.51(3)(b), sales may also be made for off-premises consumption in quantities not exceeding four liters at any one time. Wine, however, may be sold for consumption off-premises in the original package or container in any quantity regardless of whether the municipality has adopted an ordinance for carryout liquor sales. §125.51(3)(b).
Class "B" licensees may sell beer to consumers for on-premises or off-premises consumption. §125.26(1). A Class "B" license issued to a person operating a hotel authorizes that person to furnish a registered guest who has attained the legal drinking age with a selection of beer in the guest's room which is not part of the Class "B" premises. §125.26(2m).
"Class C" wine licensees may sell wine by the glass or in an opened original container for consumption on the premises where sold. "Class C" wine licenses may be granted to an applicant if the applicant meets the qualifications set out in §125.04(5) for other retail licenses. Sales of wine by the bottle for consumption on and off the premises may be authorized if all of the following apply: (1) the licensed premises is a restaurant that also operates under a "Class B" or "Class C" license and the purchaser of the wine orders food to be consumed on premise; (2) the licensees provides a dated receipt that identifies the purchase of food and the bottle of wine; and (3) the licensee securely reinserts the cork into the bottle. "Restaurant" is defined as any building, room or place at which the predominant activity is the preparation, service, or sales of meals to transients or the general public, including all placed used in connection with it. §97.01(14g), Stats.
Temporary Class "B" or "Class B" Liquor License
Temporary Class B (Picnic) Licenses are short term licenses for special events that allow the sale of beer and/or wine. This license is only issued to bona fide clubs that have been in existence for at least six months prior to the date of application; state, county, or local fair associations, or agricultural societies; a church, lodge, or society that has been in existence for at least six months prior to the date of application; and posts established of ex-servicemen’s (veterans) organizations.
